New Mexico: the home-kitchen movement
Permit program (home meals) Homemade Food Act (HB 177, 2021)
New Mexico's Homemade Food Act (HB 177, Chapter 98, signed April 6, 2021, effective July 1, 2021) lets individuals prepare nonpotentially hazardous foods at their private farm, ranch, or residence and sell them with no state permit, license, or inspection. Sellers are exempt from the Food Service Sanitation Act and the New Mexico Food Act but must label items with processor contact info, product name, ingredients, and a required allergen-exemption statement. State law preempts most local regulation, but Bernalillo County and the City of Albuquerque -- which run their own combined health department -- are allowed to establish their own joint homemade-food permitting system.
