Pennsylvania: the home-kitchen movement

Permit program (home meals) Limited Food Establishment (LFE) registration · Nonprofit/charitable private-home food exemption (7 Pa. Code § 46.212(c))

Pennsylvania has no separate 'cottage food' statute; home food businesses operate under the Food Safety Act (3 Pa.C.S.A. §§ 5721–5737) as registered Limited Food Establishments (LFEs) overseen by the PA Department of Agriculture's Bureau of Food Safety and Laboratory Services. Registration requires municipal zoning approval, a written business plan, product labeling, lab testing for certain products, a $35 fee, and a passing home-kitchen inspection before any production or sale - and there is no annual sales cap. Separately, 7 Pa. Code § 46.212(c) lets private-home food be served by nonprofits (501(c)(3)s, fire companies, school groups, etc.) for fundraisers without licensure or inspection, provided the food is non-potentially-hazardous and consumers are told it came from an unlicensed, uninspected home kitchen.

Where it stands

No legislative amendment to the Food Safety Act (3 Pa.C.S.A. §§ 5721–5737) affecting home food processing that took effect in 2024–2026 could be verified from a primary source; no 2024–2026 amendment to the LFE program's statutory rules was identified on the legislature's site. Administratively, PDA revised the Limited Food Establishment application packet in October 2024 (Rev 10-2024), which now states explicitly that residential LFE registration is 'NOT permitted in Philadelphia County' (clarifying that a Philadelphia County LFE requires NSF/ANSI equipment in a commercially zoned property), tightened the pet policy to require a physical barrier (full-closing door plus separate entrance/exit) if pets are anywhere in the home, added an employee-health-policy requirement, and lists retail, wholesale, and internet sales as permitted methods of sale. The PA Business One-Stop Shop's Homemade Craft/Food Businesses guidance was revised 4/4/2025 and confirms that homemade food businesses are Limited Food Establishments with no requirements beyond the LFE registration path. One relevant pending bill: PA Senate Bill 1444 (2025–2026, PN 1951, prime sponsor Sen. Greg Rothman), titled 'Protecting Home-Based Businesses from Burdensome Regulation,' was referred to the Senate Local Government Committee on September 24, 2026; it amends the Municipalities Planning Code's zoning provisions for home-based businesses and does not change food-safety licensing.
